1.0 About these Terms of Sale

These Terms of Sale apply to the products offered for sale and sold on the website at www.plyroom.com.au (Website). The Website is operated by Plyroom (ABN 58 006 100 465) (we/us). Each time you purchase products from the Website a binding agreement is formed between us and you incorporating these Terms of Sale and the further details specified in the purchase order you place with us using the online checkout process on the Website (Order). If you do not accept these Terms of Sale, cannot purchase products from the Website. We may vary these Terms of Sale without notice. These Terms of Sale apply as varied from time to time to all subsequent Orders placed by you.

 

1.1 Sale & Promotions 

Discounted items displayed online and applied automatically at checkout. Valid site-wide on beds and bedroom furniture accessories ordered online at www.plyroom.com.au after Sunday 4th June 2023 7:00AM AEST. Sale ends Sunday 11th June 2023 11:59 AEST. Excludes custom bedroom furniture and accessory orders and One Of A Kind bedroom furniture items. Discount cannot be used with any other offer.

  

2.0 Our products

You must open an account with us or log in as a Guest before you can purchase products from the Website (see section 8 below). The products on the Website are offered for sale on a retail basis only. You must not purchase products if you intend to resell or on-supply them to other parties in the course of conducting a business trading in those or similar products. All product prices on the Website are in Australian dollars, include GST and can change without notice. Prices are displayed exclusive of delivery charges (see section 5 below). All products available for purchase are described on their specific product page on our website. We always try to represent as accurately as possible every characteristic of the products via photography and copy points. 

We do our best efforts to provide you with the best images and description, but unfortunately cannot guarantee that colours and details in website images are 100% accurate representations of the product, and sizes might in some cases be approximate. 

Wood is a natural material that varies in color, grain pattern and overall appearance and texture. While Plyroom samples and the product images on the Plyroom website are intended to represent the natural materials used and to display various characteristics of the materials used, they do not show all variations.  This is particularly true for variations in color, pattern, texture and veining. 

Some pieces of timber may have present a small number of colour-matched patches to ensure colour consistency and the absence of knots in the timber. These are designed to give each piece a consistent face. The customer acknowledges that timber materials and hence the finished product can vary in color, pattern, and texture.

Even if not always mentioned, some self-assembly may be required on certain products.

 

3.0 Orders 

Your Order represents an offer to us to purchase a product which is accepted by us once we have sent you an email order confirmation. You must confirm your acceptance of these Terms of Sale each time you place an Order with us. You may not cancel or withdraw an Order after it is placed. 

Before ordering from us, it is your responsibility to check and determine your full ability to receive the products. This includes ensuring that the product ordered will pass freely into your room of choice, and that they fit in that room, can be transported through the front door of your house or apartment, stairs and doorways, and any other issues that could make the delivery more complicated or impossible to process. Up-to-date mobile telephone number and e-mail address are absolutely necessary to ensure successful delivery of your item.

All information asked on the checkout page must be filled in precisely and accurately. We will not be responsible for missed delivery because of wrong delivery address or an inappropriate phone number. All additional charges or costs due to delivery complications or missed delivery would thus be added to your order invoice.

We currently accept payment by credit cards, PayPal and direct deposit. You do not need a Paypal account to pay with credit or debit card using PayPal. You authorise us to charge you on and from the time you place an Order (including any delivery charges) using the payment method specified in the Order.

 

4.0 Payment

Your debit or credit card is charged for the whole amount of the order when the order is created. Plyroom uses one of the most powerful security systems on the Internet, a Secure Socket Layer (SSL) reinforced by an encryption process in order to protect all significant data related to payment.

A credit card and necessary information is needed for payment. All orders are paid only through PayPal account or by credit cards issued by companies listed on the payment page.

 

Afterpay

We offer Afterpay as an alternative to lay-buy. It is available for approved applicants only. Afterpay allows you to pay for your purchase over 4 instalments due every 2 weeks. In some cases, Afterpay may require you to make a payment at the time of purchase. 

You must be over 18 years old and be the authorised holder of an eligible debit/credit card to apply. Refer to your AfterPay contract for further details.

ZIP

We offer Zip Pay as an alternative to lay-buy. It is available for approved applicants only. Zip Pay and Zip Money allow you to pay for your purchase over regular instalments set at a frequency of your choosing. 

You must be over 18 years old and be the authorised holder of an eligible debit/credit card to apply. Refer to your Zip contract for further details.

The sale will be submitted for processing as soon as you click on the “confirm” button. You will then receive an email from us to confirm the sale and expected average delivery date.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or suspending any transaction after processing has begun.

 

5.0 Delivery charges and times

Delivery lead time may vary depending on the products ordered. Our made to order production model makes it vary from 8 to 12 weeks on average, also depending on the quantity of orders and on the vessel availability. This is only an average estimation, and some delivery can take longer, or alternatively be delivered much faster, for example for items currently in stock. All delivery estimates given at the time of placing and confirming order are subject to change. In any case, we will do our best to contact you and advise you of all changes.

While we make every effort to ensure delivery is made in a timely fashion, delays sometimes occur due to circumstances out of our control. We will not be liable for any loss or damage you may incur in the case of delay in delivery caused by circumstances out of our control (including delay due to an incorrect delivery address in an Order).

If you would you like to change the delivery address, notify change in a phone number or any other special requirements, please Contact Us or go to My Account. Any change to the order contract will have to be approved by Plyroom so we can advise you if the change(s) can be done and what would be the additional costs, if any.

Delivery charges for an Order will be specified by us during the online checkout process. By proceeding to place the Order you agree to pay us those delivery charges. Our delivery charges do not include special access requirements to the delivery address. You are responsible for costs associated with special access requirements to the delivery address. Delivery times will vary depending on your delivery location. 

 

6.0 Delivery method

Depending on the item's weight, size and quantity, different carriers and services might be used to deliver your order. 

By proceeding to place the Order you accept the carrier that we choose to use to delivery your order. You are responsible for providing the carrier access to the delivery address. If delivery is not possible in the first instance due to circumstances out of our control, we may charge you for the costs of reattempting delivery and/or storage of products pending delivery.

Depending on the carrier used, we may provide tracking details once the products specified in an Order have been dispatched. A signature may be required by the carrier for you to take delivery of your products. All deliveries will take place during normal business hours Monday-Friday 8am to 5pm. All deliveries contain valuable goods.

We deliver to street postal addresses in Australia only. All delivery costs quoted are based on delivery to a ground floor front door, unless stated otherwise. It is the buyers' responsibility to make arrangements to carry the item upstairs. Our courier company does not offer delivery upstairs. We only deliver by our nominated carriers. We may change our nominated carriers from time to time without notice.

Our couriers are contracted to produce proof of delivery. If you will not be home to accept delivery you may wish to arrange delivery to a neighbour or your office. If you are comfortable with having your order left at your front door, please indicate this in your extra delivery instructions. Please note that we take no responsibility for missing goods if you choose this option.

 

7.0 Return Policy

If you have changed your mind you are entitled to return your product(s) for a refund provided that we are informed within 14 days of delivery. All returned items must be unopened in their original wrapping, and must not be assembled or part assembled in any way. After the approval of your return, Plyroom will provide you with a refund less the delivery costs to return the product(s) and a 10% restocking fee within 7-10 days from the date we received the unopened returned product(s). Delivery costs will vary upon the number of items and your location.

Where a product is faulty, you may be entitled to a replacement, repair or refund under the Australian Consumer Law as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth). In that case, we will meet our statutory obligations to you. 

Where you purchase a product that is faulty but which is not a product of a kind ordinarily acquired for personal, domestic or household use, our liability to you is limited at our option to: replacing the product with the same or an equivalent product; or reimbursing you for the cost of having the product replaced with the same or an equivalent product; or repairing the product; or reimbursing you for the cost of having the product repaired.

 

8.0 Damaged Goods

If the delivered item does not match your order, is damaged or incorrectly supplied, please contact us as soon as possible to discuss a refund, repair or replacement.  We will ask you to send us a photo of any damage for our records to assist us in taking appropriate action. If your complaint appears valid we will arrange for collection of the item by our courier, who will advise you of a proposed collection date. We will require you to take care of the item after you have taken delivery of it until it is collected, as it might be necessary to return it to the manufacturer. Please include your customer order details with the item(s) to be returned, as these are necessary for processing a return. Once received, the items will be checked and our customer service will contact you to discuss a possible replacement or full refund.

It is your responsibility to inspect the goods within 7 days of delivery. Damage must be notified upon receipt of goods and you need to adhere to the claim process including proof of damage and arrangement of goods to be returned for inspection. Any damage or refund request after 7 days of delivery will be treated as a warranty claim. All items must be in the original wrappings and not assembled or part assembled in any way. Unless specified, all products are covered with a 24 month manufacturer's warranty if there is damage to your product due to a manufacturing defect. This warranty is not applied to commercial usage, normal wear and tear, damage arising from abnormal use or abuse and any indirect or consequential loss. Please note this does not apply to clearance items and floor-stock.

 

9.0 Tolerances

All samples seen, in-store, in printed material, online or in photographic format are considered indicative and small variations in colour, shade or grain may occur as a result of variations in screen resolution or as a result of variations in different production lots. Commencing an order or purchase from Plyroom indicates acceptance of variations.

 

10.0 Your account

You can open an account with us using the signup feature on the Website. You must confirm your acceptance of these Terms of Sale during the sign up process. You must provide complete and correct information in relation to your account. 

You must keep your account details secret and secure. You are solely responsible for the user activity that occurs in relation to your account. You must notify us immediately if you become aware of or suspect any breach of security or unauthorised use of your account. Although we will not be liable for any loss you suffer as a result of unauthorised use of your account, you may be liable for any loss we suffer. Your account will continue to stay open unless it is cancelled by us in accordance with these Terms of Sale. We may cancel your account with or without notice for any reason including if you breach (or if we have reason to believe you may breach or you intend to breach) any part of these Terms of Sale.

Cancellation of your account does not affect any Orders placed by you prior to cancellation, unless cancelation results from you breaching these Terms of Sale in relation to such Orders.

 

11.0 Privacy

Our Privacy Policy explains how we collect, use, disclose, store and grant access to personal information about you in relation to the Website.

 

12.0 Content and information

These Terms of Sale apply to all text, compilations, images, logos, data, drawings, photographs, tables, designs, trademarks, software and audio, video and other file types contained in or on the Website (Content). You may only use the Content in accordance with these Terms of Sale and as permitted by law. 

You must not use, copy, reproduce, communicate, publish, adapt, distribute, transmit, broadcast, display, sell, license or exploit any Content for any purpose other than is strictly necessary for you to use the Website without our prior consent. 

All intellectual property rights (including copyright and trade mark rights) in the Content is owned by or licensed to us. 

All information on the Website is subject to change without notice and is provided on an “as is” basis. You rely on such information at your own risk. 

We take reasonable steps to ensure the accuracy and currency of information on the Website but, to the extent permitted by law, we do not guarantee that information is correct, accurate or current or that your use of the Website will be uninterrupted, secure or error-free.

 

13.0 Links to third party websites

The inclusion in the Website of any hyperlinks or other pointers to any third party websites or applications does not imply our endorsement or approval of such third parties or their websites, products or other activities.

 

14.0 Users outside Australia

The Website may be accessed from within Australia and throughout the world, but only Australia residents may purchase products from the Website. We make no representations or warranties that the Website (including any Content) complies with the laws of any country other than Australia. If you access the Website outside Australia, you do so at your own risk and you are solely responsible for complying with the laws in the place from where you access the Website. These Terms of Sale are governed by the laws in force in the State of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia.

 

15.0 General legal terms

To the extent permitted by law, we will not be liable to you for any special, indirect or consequential loss, damage or other claim in relation to your use of the Website, including in relation to any failure or technical issues that limit or prohibit your use of the Website. Despite the security measures we employ on the Website, we will not be liable to you for any direct or indirect damage or loss (including consequential loss) suffered by you as a result of any fraudulent or unauthorised use by another person of your payment method in relation to any Orders. You indemnify us and our officers, employees, agents and contractors against any liability, loss (including consequential loss), damage that we suffer, or claims against us in relation to any breach by you of these Terms of Sale or any unlawful, illegal, negligent or tortious act or omission by you in relation to your use of the Website. Any delay or failure by us to enforce any rights under these Terms of Sale does not constitute waiver.
